New Lawsuit Seeks to Stop Arkansas’ Medical Marijuana Ballot Initiative

Arkansans Against Legalized Marijuana has filed a lawsuit to block the initiative to legalize medical marijuana in the state. The lawsuit was filed against Secretary of State Mark Martin. Claims in the suit say that the initiative as written is insufficient.

Arkansans Against Legalized Marijuana says that the act “contains misleading statements, omits material information that is essential for a fair understanding of the act and is tinged with partisan coloring,” according to reports by Arkansas Matters.

The ballot measure was approved in July for the November ballot. There is a second initiative that is still attempting to clear enough valid signatures: the Arkansas Medical Marijuana Amendment.

Few differences separate the Arkansas Medical Cannabis Act and the Arkansas Medical Marijuana Amendment. The main difference is that the Act allows patients to grow their own medical marijuana. The Amendment requires that all medical marijuana be acquired at dispensaries.

A date to hear the arguments has not been set.
