Arkansas Legislators Propose 3 New Bills to Amend State’s Medical Marijuana Laws

On January 30, State Representative Robin Lundstrum assisted in introducing three potential bills to amend the medical marijuana program. One bill may cause a bit of controversy, HB 1392, as it would ban marijuana edibles. It would not, however, ban medical marijuana patients from making their own edibles.

Senator Gary Stubbefield is a sponsor for HB1392, according to THV 11 News.  House Bill 1400, also introduced by Representative Lundstrum and sponsored by Senator Jason Rapert, bans public use of marijuana. The third bill introduced is HB1391 and would allow individual cities/towns to restrict zoning to specific locations, and zoning regulations must be in place before licenses are approved for dispensaries and cultivation facilities.

HB 1391 has an emergency clause attached. The clause reads: “Local zoning regulations permitted or prohibiting dispensaries and cultivation facilities in certain locations must take effect prior to the issuing of licenses for dispensaries and cultivation centers.” This prevents the cart going before the horse and local areas deciding after a medical marijuana business has opened that they don’t want it in that particular part of town.

HB1400 hasn’t been heard yet, only filed. Both HB1391 and HB1392 have been sent to the Committee on House Rules for further review.
